Terms of Service & End User License Agreement (EULA)

1. Scope

These Terms of Service apply to the use of the app BeeBetter (hereinafter "App"), offered by Lukas Ruszkowski, Switzerland (hereinafter "Provider"). By installing or using the App you agree to these Terms.

2. Services

BeeBetter is an iOS app that helps you maintain your social contacts and relationships. The app offers:

3. Subscriptions and Payment

3.1 Pro Subscription

The Pro subscription is available as a weekly, monthly, or annual plan. Current prices are shown in the app before purchase and include all applicable taxes.

3.2 Processing

All purchases are processed exclusively through Apple In-App Purchase. Apple's payment terms for your account apply. The Provider has no access to your payment data.

3.3 Auto-Renewal

Subscriptions automatically renew for the chosen period unless cancelled at least 24 hours before the end of the current period in your Apple account settings.

3.4 Cancellation

Subscriptions can be cancelled at any time via Apple account settings (Settings → Apple ID → Subscriptions). After cancellation, Pro access remains active until the end of the paid period.

3.5 Refunds

Refunds are handled in accordance with Apple's policies. For refund requests, contact reportaproblem.apple.com directly.

4. Account and Registration

An account is required to use the app. You are responsible for:

6. Intellectual Property

All rights to the app, design, texts, animations, and source code belong to the Provider or its licensors. Purchasing a subscription grants you a non-exclusive, non-transferable license to use the app on your own Apple devices.

7. Privacy

The processing of personal data is governed by our Privacy Policy, which forms part of these Terms.

8. Limitation of Liability

The app is provided "as is". The Provider makes no guarantee of uninterrupted availability or freedom from errors. The Provider's liability is — to the extent permitted by law — limited to intent and gross negligence.

No liability is assumed for loss of data due to device loss, account deletion, or other circumstances outside the Provider's control.

9. Apple-Specific Provisions (EULA)

The following provisions apply because you obtain the app through the Apple App Store. In the event of conflict with other provisions, these take precedence for use on Apple devices.

9.1 Parties

This End User License Agreement (EULA) is concluded solely between you and the Provider, not with Apple. The Provider alone is responsible for the app and its contents.

9.2 License Scope

The license granted to you is limited to a non-transferable license to use the app on any Apple device that you own or control, subject to the usage rules in the Apple Media Services Terms and Conditions.

9.3 Maintenance and Support

The Provider alone is responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support services.

9.4 Warranty

The Provider is solely responsible for any product warranties to the extent not effectively disclaimed. In the event that the app fails to conform to any applicable warranty, you may notify Apple; Apple will refund (where applicable) the purchase price of the app. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever. Any claims arising from failure to conform to a warranty are directed solely against the Provider.

9.5 Product Liability and Claims

The Provider, not Apple, is responsible for addressing any claims you or any third party may have in connection with the app, including: product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection law.

9.6 Intellectual Property Rights

In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, the Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9.7 Export Compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

9.8 Third-Party Terms

You must comply with applicable third-party terms of service (e.g. your mobile network operator's terms) when using the app.

9.9 Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

10. Changes to Terms

The Provider reserves the right to update these Terms. Material changes will be communicated within the app. Continued use after changes take effect constitutes acceptance.

11. Termination and Account Deletion

You can delete your account at any time in the app under Settings → Delete Account, permanently and irreversibly. All your data will be removed. Already paid subscription periods will not be refunded.

The Provider may suspend or delete accounts in the event of serious violations of these Terms.

12. Governing Law and Jurisdiction

Swiss law applies, excluding conflict of law provisions. Jurisdiction is the Provider's place of business in Switzerland, to the extent permitted by law.
